52Criteria for fit and proper person test
For the purpose of considering whether a person is a fit and proper person for any purpose under this Act, the Minister may take into account—
- the person’s regulatory compliance history; and
- the person’s related experience (if any) within the aviation or aerospace industry; and
- the person’s knowledge of the applicable regulatory requirements; and
- any history of mental health problems or serious behavioural problems; and
- any conviction for any offence and the nature of any such offence, whether or not—
- the conviction was in a New Zealand court; or
- the offence was committed before the commencement of this Act; and
- the conviction was in a New Zealand court; or
- any other information and evidence as may be relevant.
The Minister may, for the purposes of subsection (1),—
- seek and receive any information (including medical reports) as the Minister thinks fit; and
- consider information obtained from any source.
Subsection (1) applies to a body corporate with the following modifications:
- subsection (1)(a), (b), (c), (e), and (f) must be read as if it refers to the body corporate and its officers:
- subsection (1)(d) must be read as if it refers only to the officers of the body corporate.
