Offences: Additional penalty for certain offences
76Additional penalty for offences involving commercial gain or liability of the Crown under Outer Space Treaty or Liability Convention
This section applies to an offence against any of sections 65 to 71.
In addition to any penalty the court may impose for an offence referred to in subsection (1), the court may, on convicting any person of the offence,—
- order that person to pay an amount not exceeding 3 times the value of any commercial gain resulting from the commission of that offence if the court is satisfied that the offence was committed in the course of producing a commercial gain; or
- in respect of an offence against section 65, 66, or 67, order that person to pay an amount to the Crown to indemnify the Crown for any liability the Crown has incurred or may incur in respect of the launch vehicle or payload under the Outer Space Treaty or the Liability Convention or in relation to any other claim brought against the Crown under international law.
