If you operate a launch facility without a facility licence, you commit an offence. This is because section 38 says you need a licence, and you know or should know that. You must have a licence to operate a launch facility, or you will break the law. If you break this law, you can get in trouble, which may include imprisonment or a fine.

If you are an individual and you commit this offence, you can be imprisoned for up to 1 year, or you can be fined up to $50,000, or both. If you are a company and you commit this offence, you can be fined up to $250,000. You will be punished according to the law if you operate a launch facility without a licence and you know or should know that you need one.
