85: Sharing of information with agencies

The Minister can share information with certain agencies if it helps them do their job. You can think of the Minister like a person in charge of outer space activities. The agencies they can share information with include the Civil Aviation Authority, Maritime New Zealand, and the New Zealand Police.

The Minister can give these agencies any information or documents they have that might be useful. The agencies can also share information with the Minister if it helps them with their work.

If information is shared, the Minister or agency can set conditions on how it is used, like how it is stored or who can see it. This does not affect your rights to access information under the Privacy Act 2020.

This means that even if there is a contract or agreement that says something different, the Minister and agencies can still share information if it is allowed under this law.

85Sharing of information with agencies

  1. Subject to any enactment,—

  2. the Minister may provide an agency referred to in subsection (2) with any information, or a copy of any document, that the Minister—
    1. holds in relation to the performance or exercise of the Minister’s functions, duties, or powers under this Act; and
      1. considers may assist the agency in the performance or exercise of the regulatory agency’s functions, duties, or powers under any enactment; and
      2. an agency referred to in subsection (2) may provide the Minister with any information, or a copy of any document, that it—
        1. holds in relation to the performance or exercise of its functions, duties, or powers under or in relation to any enactment; and
          1. considers may assist the Minister in the performance or exercise of its functions, duties, or powers under this Act.
          2. The agencies for the purpose of subsection (1) are—

          3. the Civil Aviation Authority:
            1. Airways Corporation of New Zealand Limited:
              1. Maritime New Zealand:
                1. the Transport Accident Investigation Commission:
                  1. the Environmental Protection Authority:
                    1. WorkSafe New Zealand:
                      1. the New Zealand Police:
                        1. the New Zealand Customs Service:
                          1. any other agency in New Zealand or outside New Zealand that holds information that relates to activities to which this Act applies.
                            1. If subsection (1)(a) or (b) applies, the Minister or agency (as the case may be) may impose conditions that he or she or it thinks fit relating to the provision of the information or document, including conditions relating to—

                            2. the storage and use of, or access to, anything provided:
                              1. the copying, returning, or disposing of copies of any documents provided.
                                1. Nothing in this section limits access to information under the Privacy Act 2020.

                                2. This section applies despite anything to the contrary in any contract, deed, or document.
