68A: Operating ground-based space infrastructure without GBSI activity authorisation

If you operate ground-based space infrastructure to do a regulated activity, you must have a GBSI activity authorisation. You can find more information about this in section 49A. If you do not have this authorisation and you know or should know that you need one, you are committing an offence.

If you are found guilty of this offence, you could face punishment. As an individual, you could be imprisoned for up to one year, or you could be fined up to $50,000, or both.

If you are a company, you could be fined up to $250,000.

68AOperating ground-based space infrastructure without GBSI activity authorisation

  1. A person commits an offence if the person—

  2. operates ground-based space infrastructure to carry out a regulated activity without a GBSI activity authorisation contrary to section 49A; and
    1. knows or ought to know that a GBSI activity authorisation is required.
      1. A person who commits an offence against subsection (1) is liable on conviction,—

      2. in the case of an individual, to imprisonment for a term not exceeding 1 year or a fine not exceeding $50,000, or both; or
        1. in the case of a body corporate, to a fine not exceeding $250,000.
