You can appeal a decision made by a territorial authority or regional council. You must have already made submissions on the resolution under section 19H, 19I, 19J, or 19JAA. You have to lodge your appeal in writing at the main office of the territorial authority or regional council. You must do this on or before a certain date. This date is stated in a public notice and must be at least one month after the notice was first published. In the year before a triennial general election, the date must be on or before 3 December. When you appeal, you must say what your appeal is about. You can only raise issues that you mentioned in your original submissions.

19OAppeals

  1. Any person who or organisation (including a local board or community board) that has made submissions on a resolution made under section 19H, 19I, 19J, or 19JAA may lodge a written appeal against the decision of the territorial authority or regional council at the principal office of the territorial authority or regional council on or before the date specified in the public notice of that decision.

  2. That date—

  3. must not be earlier than 1 month after the date of the first or only publication of the public notice; and
    1. must not, in a year immediately before the year of a triennial general election, be later than 3 December.
      1. An appeal lodged under this section—

      2. must identify the matters to which the appeal relates:
        1. may raise only those matters that were raised in the appellants' submissions.
