88FWhat happens if member of local board or community board becomes member of territorial authority

  1. This section applies if, at any election other than an election to which section 88A applies, a person who is a member of a local board or community board constituted in respect of part of a district of a territorial authority is declared to be elected as a member of that territorial authority (and that person is not deprived of his or her office as a member of that territorial authority by a recount under section 92 or a petition under section 93).

  2. If this section applies, the person declared to be elected as a member of the territorial authority must be treated as having vacated office as a member of the local board or community board.
