117APower to fill by appointment extraordinary vacancy in local board or community board

  1. If a local authority, despite complying with section 120, is unable to fill by election an extraordinary vacancy in the office of an elected member of a local board or community board (being an extraordinary vacancy to which section 117(1) applies), the local board or community board may (instead of having the local authority conduct a further election in accordance with section 120) determine by resolution that the vacancy will be filled by the appointment by the local board or community board of a person named in the resolution who is qualified to be elected as a member.
