43Process for cancellation

  1. The process for cancellation is as follows:

  2. the Registrar must give the motor vehicle trader written notice of the Registrar's intention to cancel the registration of the motor vehicle trader; and
    1. the notice must—
      1. contain or be accompanied by a statement of the Registrar's reasons for the cancellation; and
        1. state that the cancellation takes effect on a specified date unless the motor vehicle trader makes, within 10 working days after receiving the notice, written representations to the Registrar as to why that trader's registration should not be so cancelled; and
        2. if any written representations are made by the motor vehicle trader within the 10-working-day period referred to in paragraph (b)(ii), the Registrar must take those representations into account in deciding whether or not to cancel the registration; and
          1. the Registrar must,—
            1. if no written representations are made by the motor vehicle trader within the 10-working-day period referred to in paragraph (b)(ii), record the cancellation on the register as soon as practicable; or
              1. if written representations are made by the motor vehicle trader within the 10-working-day period referred to in paragraph (b)(ii), give written notice to the motor vehicle trader of the Registrar's decision as soon as practicable.
              2. If the Registrar decides to cancel the registration, the Registrar must—

              3. include in the notice referred to in subsection (1)(d)(ii) a statement indicating—
                1. the grounds on which the Registrar decided to cancel the trader's registration; and
                  1. the date on which the cancellation takes effect; and
                  2. record the cancellation on the register as soon as practicable.
