82: Motor Vehicle Disputes Tribunals

The Minister has to set up one or more Motor Vehicle Disputes Tribunals. You can think of these tribunals as special groups that help solve problems related to motor vehicles. The Minister can give each tribunal a unique name and change it if needed. The Minister decides who is in each tribunal. Each tribunal has an adjudicator who is a lawyer with at least 5 years of experience. 82Motor Vehicle Disputes Tribunals

  1. The Minister must, by notice in the Gazette, establish 1 or more Motor Vehicle Disputes Tribunals for the purposes of this Act.

  2. The Minister may—

  3. give a distinctive name to each Disputes Tribunal; and
    1. change that name.
      1. Each Disputes Tribunal must consist of—

      2. an adjudicator who must be a barrister or solicitor of the High Court of not less than 5 years' practice; and
        1. an assessor appointed by the adjudicator for the purposes of each hearing from a panel maintained by the Minister under section 88.
          1. The provisions of Schedule 1 apply to every Disputes Tribunal.

          2. The Minister may, by notice in the Gazette,—

          3. disestablish a Disputes Tribunal; and
            1. direct how the records of that Disputes Tribunal are to be dealt with.
