6: Extended meaning of breach

If you know about someone breaking a rule and you’re involved in any way, that counts too. Even if you make a plan with others to break a rule, that’s considered breaking it. Remember, not following a rule is the same as breaking it.

6Extended meaning of breach

  1. In this Act, the regulations, and the Code, unless the context otherwise requires, a reference to a person who breaches a provision of this Act, the regulations, or the Code is a reference to a person who—

  2. breaches the provision; or
    1. attempts to breach the provision; or
      1. aids, abets, counsels, or procures any other person to breach the provision; or
        1. induces, or attempts to induce, any other person, whether by threats or promises or otherwise, to breach the provision; or
          1. is in any way, directly or indirectly, knowingly concerned in, or party to, the breach by any other person of the provision; or
            1. conspires with any other person to breach the provision.

              1. A breach includes a failure to comply.
