Electricity Industry Act 2010

Electricity industry governance - Who does what - Industry participants and specified persons

10: Exemption from obligation to register

You could also call this:

“Some people or groups don't have to sign up as electricity industry participants”

You don’t have to register as an industry participant if you’re part of a group that the rules say doesn’t need to register. The Authority can also give you a special pass not to register if they think it’s okay. They’ll write down why they’re letting you off.

The Authority will only give you a special pass if they think it’s not important for you to register and if it will save time and money overall.

The Authority can change or take away your special pass, but they have to tell you first and let you have your say. They’ll only do this if they think it’s really important and if it will help more than it will cause problems.

If the Authority gives you a special pass or changes it, they have to put a notice in the Gazette, which is like a special government newspaper.

The Authority has to let everyone know about all the groups and people who don’t have to register.

Part 2 Electricity industry governance
Who does what: Industry participants and specified persons

10Exemption from obligation to register

  1. Despite section 9(1)(a), an industry participant need not register if—

  2. it is a member of a class of industry participants identified in regulations made under section 110 as a class of industry participants that is exempt from the obligation to register; or
    1. the Authority exempts the participant by issuing an individual exemption notice that—
      1. identifies the industry participant that is exempt from the obligation to register; and
        1. gives reasons for the exemption.
        2. The Authority may grant an individual exemption to an industry participant only if the Authority is satisfied that—

        3. it is not necessary, for the purpose of achieving the Authority's objectives under section 15, for the participant to be registered; and
          1. exempting the participant will reduce overall administration and compliance costs.
            1. The Authority may amend or revoke an individual exemption, by issuing a notice that identifies the exempt participant and gives reasons for the amendment or revocation, but only if the Authority—

            2. has given notice of the proposed amendment or revocation to the exempt participant and given the participant a reasonable opportunity to comment on the proposal; and
              1. is satisfied that—
                1. the amendment or revocation is necessary or desirable for the purpose of achieving the Authority's objectives under section 15; and
                  1. the benefit of the amendment or revocation outweighs any disadvantage resulting from any increased administration and compliance costs.
                  2. A notice issued under subsection (1)(b) or (3) must be published in the Gazette.

                  3. The Authority must publicise a list of all current class and individual exemptions.
