24: Membership of Rulings Panel

The Rulings Panel can have up to 5 members. The Governor-General chooses these members. One of these members will be the chairperson. The chairperson must be a lawyer who has worked for at least 7 years in the High Court. Another member will be the deputy chairperson.

When the Governor-General wants to choose someone for the Rulings Panel, they need to follow the Minister’s recommendation. Before making a recommendation, the Minister talks to the Minister of Justice and the Authority.

24Membership of Rulings Panel

  1. The Rulings Panel comprises up to 5 members appointed by the Governor-General.

  2. The Governor-General must appoint—

  3. 1 member to be the chairperson of the Rulings Panel, who must be a barrister or solicitor of the High Court of at least 7 years' standing; and
    1. 1 member to be deputy chairperson of the Rulings Panel.
      1. The Governor-General may make an appointment under subsection (1) or (2) only in accordance with a recommendation by the Minister given after the Minister has consulted with the Minister of Justice and the Authority.

      2. Further provisions relating to the membership of the Rulings Panel may be set out in regulations made under section 112.
