115: General regulation-making power

The Governor-General can make regulations about two main things under this Act.

First, they can set rules about fees or charges. This means they can decide what you need to pay for, how much it costs, and how to figure out the price. They can also say who has to pay and when you might not have to pay or could get your money back.

Second, they can make rules about anything else that’s needed to make sure this Act works properly and is managed well.

When the Governor-General makes these regulations, they become what’s called “secondary legislation”. This means they have to follow special rules about how they’re published, which you can find in Part 3 of the Legislation Act 2019.

115General regulation-making power

  1. The Governor-General may from time to time, by Order in Council, make regulations for all or any of the following purposes:

  2. prescribing the matters in respect of which fees or charges are payable under this Act or the regulations, the amounts of those fees or charges, or the method or rates by which they are to be assessed, the persons liable for payment of those fees or charges, and the circumstances in which the payment of the whole or any part of those fees or charges may be refunded or waived:
    1. providing for such other matters as are contemplated by, or are necessary for giving full effect to, this Act and for its due administration.
      1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
