98: Offence to fail to comply with District Court order

"You must follow District Court orders or you might get in trouble"

If you are or were a member of the dispute resolution scheme, you need to follow any orders given by the District Court under section 97. If you know about an order and don't follow it, or don't follow it in the right way or at the right time, you are breaking the law. This is called an offence. If you do this, you might have to pay a fine of up to $100,000.

However, this rule doesn't apply to all parts of the District Court's orders. Some parts mentioned in section 97(4) are not included in this rule.

98Offence to fail to comply with District Court order

  1. A member or former member of the dispute resolution scheme who, knowing that the member or former member is subject to an order made under section 97, fails to comply with the order, or fails to comply with the order within the time or in the manner required by the order, commits an offence and is liable on conviction to a fine not exceeding $100,000.

  2. Nothing in this section applies to an order or part of an order of the District Court referred to in section 97(4).
