The Minister can approve a body or organisation to be in charge of labelling films. You can apply to be this labelling body by following the rules in section 73. The Minister will decide if you can be the labelling body. The Minister's decision will be published in the Gazette and will start from the date of the notice. The approval will keep going until it is stopped under section 75. The Minister can say yes, but only if you agree to some conditions. 72Approval of labelling body

  1. Subject to this section, the Minister may from time to time, on application made to the Minister in accordance with section 73, approve any body or organisation to act as the labelling body for the purposes of this Act.

  2. An approval under this section shall—

  3. be made by notice published in the Gazette, and shall take effect from the date of such notice or such later date as may be specified in the notice; and
    1. continue in force until it is revoked under section 75.
      1. The Minister may grant an approval under this section subject to such conditions as the Minister thinks fit.

      2. The Minister shall not approve a body or organisation under this section unless the Minister is satisfied that—

      3. the body or organisation is representative of the following persons:
        1. persons engaged in the distribution or public supply of films in New Zealand; and
          1. persons engaged in the production of films in New Zealand; and
            1. persons engaged in the public exhibition of films in New Zealand; and
            2. the body or organisation is capable of implementing a system to assign a rating and description to any film referred to it for the issue of a label; and
              1. the body or organisation will take all reasonable steps to ensure that notice of the rating and description assigned to any such film is disseminated to persons engaged in the production, distribution, public exhibition, or public supply of films.
                1. The Minister shall not decline an application for approval under this section without first giving the applicant—

                2. a copy of any information on which the Minister relies in proposing to decline the application; and
                  1. a reasonable opportunity to make written submissions to the Minister in relation to that information.
