174Restrictions on redundancy and other entitlements

  1. Where—

  2. any employee of the Department of Internal Affairs ceases to be employed by that department; and
    1. on or before the date on which that employment so ceases, that employee receives an offer of employment in the Classification Office, being an offer of employment on terms and conditions that, taken as a whole, are substantially similar to, or better than, the terms and conditions of employment applying to that person immediately before that date,—
      1. then, notwithstanding the terms of that employee's contract of service with the Department of Internal Affairs, that employee shall not be entitled to receive any payment or other benefit from that department by reason only of that person so ceasing to be an employee of that department, whether or not that person accepts that offer of employment in the Classification Office.
