This page is about a bill. That means that it's not the law yet, but some people want it to be the law. It could change quickly, and some of the information is just a draft.

Offshore Renewable Energy Bill

Amendments to other Acts - Amendments to Fast-track Approvals Act 2024

177B: Section 5 amended (Meaning of ineligible activity)

You could also call this:

"Changes to what activities are not allowed under the new offshore renewable energy law"

Illustration for Offshore Renewable Energy Bill

The proposed law change affects what is called an ineligible activity. You will see changes to section 5. In this section, new words are added after "section 38(3)". The new words are "or 38C(1)".

Another change replaces a part of section 5. This part is about ORE infrastructure activities, which are defined in section 4 of the Offshore Renewable Energy Act 2024. You can find these activities under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 or the Resource Management Act 1991, but there is an exception. The exception is if you have a current feasibility permit or commercial permit under the Offshore Renewable Energy Act 2024 for the ORE generation infrastructure activities.
