If you get a compliance notice, this section might apply to you. The person in charge of making sure you follow the rules, called the enforcement officer, can give you more time to comply with the notice. They can do this on their own or if you ask them to.

The enforcement officer can only give you more time if the time to comply has not run out yet. If you ask for more time at least 2 weeks before the deadline, but the enforcement officer has not made a decision by then, you get 2 more weeks to comply. This extra time is so the enforcement officer can make a decision about your request.

131Extension of time for compliance with compliance notices

  1. This section applies if a person has been issued with a compliance notice.

  2. The enforcement officer may, on their own initiative or on the application of the person, by written notice given to the person, extend the compliance period for the compliance notice.

  3. However, the enforcement officer may extend the compliance period only if the period has not ended.

  4. If a person applies for an extension 2 weeks or more before the end of the compliance period, but a decision on that application has not been reached before the compliance period ends, the compliance period is to be treated as having been extended by an additional 2 weeks to enable the decision to be made.
