158Pecuniary penalty order

  1. A court of competent jurisdiction may, on the application of an enforcement officer, make a pecuniary penalty order against a person if satisfied that the person has committed a pecuniary penalty contravention against section 157.

  2. Proceedings under this section may be commenced within 3 years after the matter giving rise to the contravention was discovered or ought reasonably to have been discovered.

  3. A pecuniary penalty order is an order that a person must pay to the Crown a pecuniary penalty that the court determines to be appropriate (a pecuniary penalty).
