155: Offence for contravening compliance notice

If you do not follow a compliance notice without a good reason, you might commit an offence. This is because the proposed law says you must comply with what a compliance notice says, as outlined in section 130. You can be fined up to $200,000 if you are found guilty of not following a compliance notice.
If a compliance notice gives you recommendations, you do not have to follow them, and you will not commit an offence if you do not. The proposed law only requires you to follow the parts of the compliance notice that you must do, not the recommendations.
You will only commit an offence if you do not follow the parts of the compliance notice that you are required to follow, and you do not have a good reason for not following them.

155Offence for contravening compliance notice
A person commits an offence if, without reasonable excuse, they contravene, or permit the contravention of, section 130 (which relates to the requirement to comply with a compliance notice).
A person who commits an offence against this section is liable on conviction to a fine not exceeding $200,000.
It is not an offence to fail to comply with recommendations in a compliance notice.
