You can apply for a temporary licence if you are a certain person. This includes a manager of an estate under the Protection of Personal and Property Rights Act 1988, or a personal representative of a deceased licensee. You can also apply if you are an assignee in bankruptcy, a liquidator or receiver of a company, or a nominated representative of a sick or absent licensee. You need to apply to the Registrar in a prescribed form to carry on or appoint someone to carry on the business. The Registrar can authorise you to carry on the business for up to 2 months while your application is being considered.

62Temporary licence

  1. A reference in this section to a licensee is a reference to a licensee who is an agent.

  2. Any of the following persons may apply to the Registrar in the prescribed form for permission to carry on or appoint some other person to carry on the licensee’s business as an agent for a period specified by the Registrar:

  3. in the case of a licensee who is a person subject to a property order under the Protection of Personal and Property Rights Act 1988, the manager of his or her estate; or
    1. in the case of a licensee who is deceased, his or her personal representative; or
      1. in the case of a licensee who has been adjudicated bankrupt, his or her assignee in bankruptcy; or
        1. in the case of a licensee company that is in liquidation or receivership, the liquidator or receiver of that company, as the case may be; or
          1. in the case of a licensee who is sick, absent, or is otherwise temporarily prevented from carrying on business as a real estate agent, his or her nominated representative; or
            1. in the case of a licensee building society that is being dissolved, the liquidator or other person conducting its dissolution, or a trustee appointed under an instrument of dissolution of the building society.
              1. If, under subsection (2), a person mentioned in that subsection has applied to the Registrar for permission to carry on or to appoint some other person to carry on a licensee’s business, then, until the application has been determined, the Registrar may, in writing, authorise the applicant to carry on the licensee’s business, either personally or by an agent, for any period not exceeding 2 months.

              2. Despite subsection (3), an authority given under that subsection in any event ceases to have effect when the application for the Registrar’s permission under subsection (2) is determined.
