Provisions relating to repeal of Real Estate Agents Act 1976: Transitional provisions
166Agents licensed under Real Estate Agents Act 1976
Every person is deemed to hold a licence as an agent under this Act who, immediately before the commencement of this section, holds a current agent’s licence under the Real Estate Agents Act 1976.
The licence that the person is deemed to hold under subsection (1) continues in force, until the expiration of the year in respect of which the licence was issued under the Real Estate Agents Act 1976 and may be renewed under this Act.
Every person is deemed to hold a licence as an agent under this Act if, immediately before the commencement of this section, the person is entitled to apply for a renewal of his or her or its agent’s licence under the Real Estate Agents Act 1976 and, on the commencement of this Act, the person’s application for that renewal is pending before the Real Estate Agents Licensing Board.
The licence that the person is deemed to hold under subsection (3) continues in force until the Authority has been notified by the Real Estate Agents Licensing Board under section 169(2) of the Board’s determination and has taken any appropriate action on that advice.
This section does not limit the provisions of this Act that authorise the cancellation of a licence or the suspension of a licensee.
