You can stop someone from dealing with radio frequencies if you claim to have rights to them. You can do this by lodging a caveat with the Registrar in the prescribed form. You must say why you are lodging the caveat. You can claim rights to radio frequencies or a spectrum licence. You can also transfer these rights to someone else to hold in trust. Caveats

89Caveat against dealing with radio frequencies

  1. Any person—

  2. claiming to be entitled to, or to be beneficially interested in,—by virtue of any unregistered agreement or other instrument, or of any trust expressed or implied, or otherwise howsoever; or
    1. the management rights in relation to any radio frequencies in respect of which a record of management rights is registered under this Act; or
      1. any spectrum licence—
      2. transferring—to any other person to be held in trust—
        1. the management rights in relation to any such radio frequencies; or
          1. any spectrum licence—
          2. may at any time lodge with the Registrar a caveat in the prescribed form.

          3. Every caveat lodged under subsection (1) shall contain a statement of the grounds on which the caveat is lodged.

          4. No caveat may be lodged pursuant to subsection (1)(a) in respect of any entitlement or beneficial interest arising or claimed to have arisen before the commencement of this Act.
