23Eligibility to apply for registration of nominated sex

  1. A person may apply to the Registrar-General for registration of the person’s nominated sex only if—

  2. the person’s birth is registered under this Act; and
    1. the person is 16 years old or older.
      1. The guardian of a child may apply to the Registrar-General for registration of the child’s nominated sex only if—

      2. the child’s birth is registered under this Act; and
        1. the guardian has the child’s consent.
