Part 6Register, regulations, amendments, and other miscellaneous provisions
Regulations
255Fees
The Governor-General may, by Order in Council, make regulations prescribing—
- fees or other amounts payable to the Registrar for the performance of functions or the exercise of powers under this Act or the regulations or the manner in which those fees or amounts may be calculated:
- amounts payable to the Registrar by way of penalty for failure to deliver a document to the Registrar within the time prescribed by or under this Act:
- fees or other amounts payable to the Registrar for any other matter under this Act or the regulations or the manner in which those fees or amounts may be calculated.
The Registrar may refuse to perform a function or exercise a power until the fee or amount prescribed by the regulations is paid.
The regulations may authorise the Registrar to refund or waive, in whole or in part and on the conditions that may be prescribed, payment by 1 or more named persons of any fee or amount referred to in this section.
A fee or an amount payable to the Registrar is recoverable by the Registrar in any court of competent jurisdiction as a debt due to the Crown.
Regulations made under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
