176When society may request removal

  1. A request under section 175(1)(a) may be made on the grounds—

  2. that the society has ceased to operate, has discharged in full its debts and liabilities to all its known creditors, and has distributed its surplus assets in accordance with its constitution and this Act; or
    1. that the society has no surplus assets after paying its debts and liabilities in full or in part, and no creditor has applied to the court under subpart 4 for an order putting the society into liquidation.
      1. A request must be made in the manner prescribed by the regulations (if any).
