If you are a member of an armed force from another country, you might be subject to this Act. This happens when you are training or exercising with the Armed Forces of New Zealand in a defence area, ship, or unit. You will be subject to this Act during that time, unless a Defence Force Order says otherwise. If this Act applies to you because you are training with the Armed Forces of New Zealand, some special rules apply. If you have a rank in your own armed force, this Act will apply to you in a similar way as it does to someone with the same rank in the Armed Forces of New Zealand. If you do not have a rank, this Act will apply to you in a similar way as it does to a rating of able rank, a private, or a leading aviator classification. You should note that a Defence Force Order can change how this Act applies to you, and some parts of the Act might not apply to you at all, or might apply in a different way.

11Trainees

  1. Subject to subsection (2), where any person, not otherwise being subject to this Act, is a member of any armed force other than the Armed Forces of New Zealand (not being a force excepted from the provisions of this subsection by Defence Force Order), he shall be subject to this Act during any period when he is under orders to carry out any training or exercise in any defence area or ship or with any unit or other part of the Armed Forces.

  2. Subject to any Defence Force Order to the contrary, where, by virtue of this section, this Act applies to a person who is not a member of the Armed Forces of New Zealand, the following provisions shall apply:

  3. if the person holds a rank in an armed force, this Act shall, subject to such exceptions and modifications as may be prescribed, apply to him in the same manner and to the same extent as it applies to a person holding the corresponding rank in the Armed Forces:
    1. in any other case, this Act shall, subject to such exceptions and modifications as may be prescribed, apply to him in the same manner and to the same extent as it applies to a rating of able rank or to a private or a leading aviator classification.
