25Unauthorised disclosure of information

  1. Every person subject to this Act commits an offence, and is liable to imprisonment for a term not exceeding 2 years, who knowingly, and with knowledge that he is acting without proper authority, communicates to any other person any relevant information (as defined in section 78A of the Crimes Act 1961), not being relevant information that is publicly available, or delivers to any other person any object (as defined in that provision of that Act), knowing that the communication of that information or the delivery of that object is likely—

  2. to prejudice the security or defence of New Zealand; or
    1. to prejudice the entrusting of information, being information relating directly or indirectly to the security or defence of New Zealand or otherwise of use or interest to the Armed Forces of New Zealand, to the Government of New Zealand on a basis of confidence by—
      1. the government of any other country or any agency of such a government; or
        1. any international organisation.
