20: Duty to act independently

You could also call this:

"The Commissioner must make their own decisions without being told what to do by someone else."

Illustration for Privacy Act 2020

The Commissioner has to act independently when doing their job. You can think of this as the Commissioner making their own decisions without being told what to do by someone else. This means they must act independently under this Act and any other Act that says what the Commissioner's job is, except for the Crown Entities Act 2004, which you can read more about at the Crown Entities Act 2004 link. The Commissioner must make their own decisions when performing their duties and using their powers. This helps keep the Commissioner's work fair and unbiased. You can trust that the Commissioner will do their job without being influenced by others.
