Appeal against access direction
108Determination of appeal
The Tribunal may require the Commissioner to provide either or both of the following:
- a written report setting out the considerations to which the Commissioner had regard in making the access direction:
- any information held by the Commissioner relating to the making of the access direction that is required to determine the appeal.
At the hearing of an appeal (other than an appeal determined on the papers), the Commissioner is entitled to appear in person, or by a representative, and be heard.
The Tribunal may determine an appeal by—
- confirming the direction appealed against:
- modifying the direction appealed against:
- reversing the direction appealed against.
The Tribunal may award damages in accordance with section 103.
