69: Minister may declare state of local emergency in certain cases

The Minister can declare a state of local emergency if they think an emergency has happened or might happen in an area. This can be done if a state of local emergency has not already been declared for that area under section 68. If the Minister declares a state of local emergency, it can be for a whole area or just a part of it.

If the Minister declares a state of local emergency for a whole area, any other states of local emergency already in place for parts of that area will stop. The same thing happens if the Minister declares a state of local emergency for a district within an area - any other states of local emergency already in place for parts of that district will stop.

The Minister cannot declare a state of local emergency for an area if a state of national emergency is already in place for that area.

69Minister may declare state of local emergency in certain cases

  1. If at any time it appears to the Minister that an emergency has occurred or may occur in the area of any Civil Defence Emergency Management Group and a state of local emergency has not been declared under section 68, the Minister may declare a state of local emergency for that area.

  2. If the Minister declares a state of local emergency for—

  3. the whole area of a Civil Defence Emergency Management Group, then any other state of local emergency already in force for 1 or more districts or wards within the area ceases to have effect:
    1. a district within the area of a Civil Defence Emergency Management Group, then any other state of local emergency already in force for 1 or more wards within the district ceases to have effect.
      1. Nothing in this section authorises the Minister to declare a state of local emergency for any part of New Zealand while a state of national emergency is in force in respect of that part.
