94C: Commencement and duration of transition periods

When a state of emergency is declared for an area, a transition period starts after the state of emergency ends. This can happen in two ways: the state of emergency can be terminated under section 72(1) of the law, or it can expire under section 70(3) or 71(4) of the law, if the transition notice says so. If a state of emergency is not declared, a transition period starts when the notice of transition is given. A transition period can be national or local, and they have different time limits.

94CCommencement and duration of transition periods

  1. A transition period for an area, or part of an area, for which a state of emergency has been declared comes into force—

  2. on the termination of the state of emergency under section 72(1); or
    1. on the expiry of the state of emergency under section 70(3) or 71(4), if the transition notice states that the transition period comes into force on the expiry of the state of emergency.
      1. In any other case, a transition period comes into force at the time and on the date the notice of transition is given.

      2. A national transition period ends 90 days after the time and date on which the period comes into force, unless extended or terminated earlier.

      3. A local transition period ends 28 days after the time and date on which the period comes into force, unless extended or terminated earlier.
