Civil Defence Emergency Management Act 2002

Powers in relation to civil defence emergency management

94: Contracts in urgent cases

You could also call this:

"Making urgent deals during an emergency"

During a state of emergency, you can enter into contracts on behalf of a Civil Defence Emergency Management Group for certain purposes. This is allowed under the Civil Defence Emergency Management Act 2002, despite what the Public Bodies Contracts Act 1959 says, which you can find at https://legislation.govt.nz/act/public/1986/0120/latest/link.aspx?id=DLM324218. You can do this if you are the chairperson, deputy chairperson, an authorised employee, or the Group Controller.

If you use this power, you must tell the Civil Defence Emergency Management Group about it at their next meeting. You have to explain the full circumstances of what you did. If you cannot do this at the next meeting, you must do it at the following meeting.

You must follow the rules and report what you have done to the Group. This is an important part of being able to enter into contracts during a state of emergency.
