87: Entry on premises

If a state of emergency is happening in an area, a Controller or a constable, or someone acting under their authority, can enter any premises or place in that area. They can do this if they think it's necessary to save lives, prevent injuries, or rescue people who are hurt or in danger. They can also enter premises to help people who are suffering or in distress, and to carry out urgent relief measures, as stated in section 61 of a related law. You should be aware that a Controller or constable can break into premises if necessary, to achieve these goals. This is allowed under the law, which was amended on 1 October 2008, pursuant to section 116(a)(ii) of the Policing Act 2008.

87Entry on premises

  1. If a state of emergency is in force in any area, a Controller or a constable, or any person acting under the authority of a Controller or constable, may enter on, and if necessary break into, any premises or place within the area or district in respect of which the state of emergency is in force if he or she believes on reasonable grounds that the action is necessary for—

  2. saving life, preventing injury, or rescuing and removing injured or endangered persons; or
    1. permitting or facilitating the carrying out of any urgent measure for the relief of suffering or distress.
