If you get information because of a requirement under sections like section 60, you can only use or share that information for the purposes of the Civil Defence Emergency Management Act. You might get this information when someone asks you for it or when a warrant is issued under section 78. You can use the information to help with civil defence emergency management.

If a state of emergency has been declared or a notice of transition period has been given, you can share some information with a responsible person. This information must be relevant to the exercise of powers under subpart 6B of Part 2 of the Building Act 2004 in that area. The information must also be used in connection with the exercise of those powers in that area.

83Restriction on disclosure of information

  1. A person who receives information following a requirement to give information imposed under section 60, 76, 91(2), or 94N(2), or in the execution of a warrant issued under section 78, may use or disclose that information only for the purposes of this Act.

  2. Despite subsection (1), the person may disclose to a responsible person information that—

  3. is relevant to the exercise of powers under subpart 6B of Part 2 of the Building Act 2004 in an area for which a state of emergency has been declared or a notice of transition period has been given; and
    1. is to be used in connection with the exercise of those powers in that area.
      1. In subsection (2), responsible person has the same meaning as in section 133BB(1) of the Building Act 2004.
