If you give a direction under section 91(2)(a) or (b) of the Civil Defence Emergency Management Act 2002, you must try to notify the owners and occupiers of the structure and adjacent land about the direction. You can find more information about this in section 91(2)(a) or (b) and section 114. You must also attach a copy of the notice to a prominent place on or near the structure.

If you give a direction under section 91(2)(b), you must also give public notice of the direction. The notice you give must state the reasons for the direction, describe what the direction applies to, and say when assessments will be carried out.

The notice must also say where you can find more information and be published in the Gazette as soon as possible.

91ANotice requirements

  1. A person who gives a direction under section 91(2)(a) or (b)

  2. must use reasonable endeavours, in accordance with section 114, to notify—
    1. each owner (or each owner’s agent) and each occupier of the structure of the direction; and
      1. each owner (or each owner’s agent) and each occupier of any adjacent structure or adjoining land of the direction; and
      2. must attach a copy of the notice to a prominent place on, or adjacent to, the structure.
        1. A person who gives a direction under section 91(2)(b) must also give public notice of the direction that is reasonable in the circumstances.

        2. A notice given under this section must—

        3. state the reasons for giving the direction; and
          1. describe the matter to which the direction applies; and
            1. state when the assessments are to be carried out; and
              1. state where any further information may be viewed; and
                1. be published in the Gazette as soon as practicable.
