When a state of emergency is declared, it must say what time and date it starts. You know a state of emergency has started when the declaration is made, at the time and date it says. It lasts for 7 days from when it starts.

If a state of emergency is declared, it will end after 7 days, unless something else happens. Nothing stops a state of emergency from being extended under section 71, or ended under section 72. You can think of the 7 days as starting from when the state of emergency begins, and ending at the same time, 7 days later.

When you count the 7 days, you start from the time the state of emergency begins, and finish at the same time, on the seventh day. This means the state of emergency will end at the same time of day it started, 7 days later.

70Commencement and duration of state of emergency

  1. A declaration of a state of emergency must specify the time and date on which the declaration is made.

  2. A state of emergency comes into force at the time and on the date that a declaration of the state of emergency is made.

  3. A state of emergency expires 7 days after the time and date on which the state of emergency comes into force.

  4. Nothing in this section prevents—

  5. the extension of a state of emergency under section 71; or
    1. the termination of a state of emergency under section 72.
      1. For the purposes of this section, 7 days after the time and date on which the state of emergency comes into force means immediately after a period that—

      2. begins immediately after the time of the day on which the state of emergency comes into force; and
        1. ends immediately before the same time of the day on the date that is 7 days after the day on which the state of emergency comes into force.
          1. Example

            If a state of emergency came into force at 9.35 am on 1 January, it would expire at 9.35 am on 8 January. If the state of emergency came into force at 9.35 am on a Friday, it would expire at 9.35 am on the following Friday.
