121: Proceedings not affected

You could also call this:

"Court cases and claims started before this law began are not changed by this law."

If you are involved in a court case that started before this Act began, this Act does not change your rights. You can still go to court and have your case heard as it was before this Act started. This Act also does not affect claims for compensation that were started under the Civil Defence Act 1983.

You can continue with your claim for compensation as if the Civil Defence Act 1983 was still in force. This means you can finish your claim in the same way you would have before this Act began. The rules from the Civil Defence Act 1983 still apply to your claim.

121Proceedings not affected

  1. Nothing in this Act affects the rights of any party to any proceedings commenced in any court before the commencement of this Act.

  2. All claims for compensation commenced under any provisions repealed by this Act may be continued and completed in all respects as if the Civil Defence Act 1983 remained in force.
