Civil Defence Emergency Management Act 2002

Declaration of state of emergency - General provisions applying to declaration of state of national emergency or state of local emergency

72: Termination of state of emergency

You could also call this:

"How a state of emergency can be stopped"

When you are in a state of emergency, it can be terminated by a person who is allowed to make that decision. They can do this by making a declaration, and it does not matter if they were the one who started the state of emergency or not. This declaration must include the time and date it is made.

The state of emergency ends as soon as the declaration is made. You do not have to wait for anything else to happen.

A state of local emergency can also end in another way, which is when a notice of a local transition period given by the Minister under section 94B(3) comes into force.
