The board of Fire and Emergency New Zealand can give some of its jobs to other people. 24Delegation of functions, duties, and powers

  1. The board may delegate any of the functions, duties, and powers of FENZ or the board, either generally or specifically, to any of the following persons by resolution and written notice to the person or persons:

  2. FENZ personnel:
    1. a member or members of the board:
      1. a committee:
        1. any other person or persons approved by the board:
          1. any class of persons that comprises any of the persons listed in paragraphs (a) to (d):
            1. a Crown entity subsidiary of FENZ.

The board may only delegate, and a delegate may only subdelegate, the performance or exercise of a function, duty, or power to a person who the board or the delegate (as the case may be) is satisfied is suitably qualified or trained to perform or exercise the function, duty, or power.

              2. A delegate to whom any functions or powers of FENZ or the board are delegated may, subject to any conditions set out in the delegation,—

              3. perform the function or exercise the power in the same manner, subject to the same restrictions, and with the same effect as if the person were FENZ or the board; and
                1. delegate the function or power subject to the same restrictions, and with the same effect, as if the subdelegate were the delegate.
                  1. However, in cases of delegations made to or by persons in the private sector, a delegate may subdelegate the function or power only with the prior written consent of the board.

                  2. A delegation or subdelegation may be revoked at any time by written notice of the board to the delegate, or by written notice of the board or the delegate to the subdelegate (as the case may be).

                  3. Sections 73(1) to (3), 74(1), and 76(2) of the Crown Entities Act 2004 do not apply to any delegations or subdelegations made under this section.

                  4. In this section, private sector means any person or organisation outside the State services as defined in section 5 of the Public Service Act 2020.
