You can still apply for judicial review or start another court case. This law does not stop you from doing that. You can go to any court or tribunal you like. If you take someone to court over something they did, you cannot use the dispute resolution scheme for the same thing at the same time, unless the court says it is okay. The dispute resolution scheme will wait until the court case is finished. This is so you do not have two cases going on about the same thing.

184Other proceedings

  1. Nothing in this subpart affects the right of any person to—

  2. apply for judicial review:
    1. commence any other proceeding in any court or tribunal.
      1. If a proceeding relating to any conduct is commenced in a court or tribunal, a proceeding before the dispute resolution scheme relating to the same conduct is stayed (unless the court or tribunal orders otherwise).
