187General regulation-making power

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations for 1 or more of the following purposes:

    Fees and charges

  2. prescribing fees and charges payable in respect of any matter under this Act or the manner in which fees and charges may be calculated:
    1. Dispute resolution scheme

    2. prescribing the kinds of disputes excluded from the dispute resolution scheme and other matters for the purposes of section 180(1)(m):
      1. Offences and penalties

      2. creating offences in respect of the contravention of regulations made under this Act or the contravention of a provision of this Act and providing for the imposition of fines, which must not exceed—
        1. $15,000, in the case of an individual:
          1. $30,000, in any other case:
          2. Infringement offences

          3. prescribing infringement offences for the purposes of this Act and regulations made under this Act:
            1. setting the infringement fee payable for an infringement offence, which must not exceed—
              1. $1,000, in the case of an individual:
                1. $5,000, in any other case:
                2. setting different infringement fees for different infringement offences or in respect of different persons or individuals:
                  1. prescribing the form of infringement notices and infringement offence reminder notices:
                    1. Definitions

                    2. prescribing other purposes for the purposes of the definition of fire as a land management tool in section 6:
                      1. prescribing a place or thing, or a type of place or thing, for the purposes of the definition of fire in open air in section 6 and the definition of in open air in section 61:
                        1. specifying a material or class of material as spontaneously combustible material for the purposes of section 159:
                          1. Public notification

                          2. prescribing requirements relating to the giving of public notice of any document or other matter:
                            1. Forms

                            2. prescribing the information that must be contained in forms for the purposes of this Act:
                              1. General

                              2. providing for any matters contemplated by this Act, necessary for its administration, or necessary for giving it full effect.
                                1. Regulations made under this Act may apply—

                                2. generally throughout New Zealand or in particular areas of New Zealand only; and
                                  1. generally over a range of circumstances or in particular circumstances only.
                                    1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
