29Revocation of right to certify electronic instruments

  1. The Registrar may, by notice, revoke a person's authority to give a certificate for electronic instruments if the Registrar believes on reasonable grounds that the person—

  2. has given a fraudulent certificate for an electronic instrument; or
    1. has given a certificate that is materially incorrect for an electronic instrument; or
      1. has failed to comply with a requirement under section 30 (which relates to retaining evidence of certifications and providing information) or any of sections 78(2)(b), 80(1)(b), or 84.
        1. The Registrar may revoke a person's authority under subsection (1)(a) immediately, but must then consider any submissions or representations made by or on behalf of the person.

        2. If the Registrar decides to uphold the revocation after considering those submissions or representations, the Registrar must give notice of that decision to the person.

        3. The Registrar may revoke a person's authority under subsection (1)(b) or (c) only after—

        4. giving the person not less than 10 working days' notice of intention to do so; and
          1. considering any submissions or representations made by or on behalf of the person.
            1. The Registrar may, by notice, reinstate any person's authority that was revoked under this section if the Registrar is satisfied that the person—

            2. will not give a certificate that is fraudulent or materially incorrect for an electronic instrument; and
              1. will comply with sections 30, 78(2)(b), 80(1)(b), and 84.
