You can ask the Registrar for a copy of something in the register. You must pay a fee for this. The Registrar can give you a copy of an instrument or a record of title. You can ask for a certified copy if you need one. The Registrar can give you a copy in electronic form if the chief executive says it is okay. There are some rules that can stop you getting a copy. These rules are in section 41, Part 9 of the Family Violence Act 2018, and the Public Records Act 2005. The Registrar must follow these rules when giving you a copy.

40Access to register

  1. The Registrar must, on request and on payment of the prescribed fee or charge,—

  2. provide a person with a copy of an instrument registered or noted in the register or that forms part of the register:
    1. provide a person with a copy of a record of title.
      1. If the person requires the copy of the instrument or record of title to be a certified copy, the Registrar must provide a certified copy.

      2. The copies referred to in subsection (1) may be provided in electronic form if the chief executive so determines.

      3. A determination under subsection (3) may be made subject to specified conditions.

      4. This section is subject to—

      5. section 41, Part 9 of the Family Violence Act 2018, and any other enactment under which information may be withheld; and
        1. the Public Records Act 2005.
