229Fees and charges

  1. Regulations made under section 227 may specify—

  2. the fees and charges payable for—
    1. the performance or exercise of functions, duties, or powers of the Registrar under this Act or any other enactment:
      1. the performance or exercise of functions, duties, or powers of the chief executive under this Act:
        1. the performance of functions of the chief executive in relation to the administration and operation of this Act, including the provision of the register and other facilities and services by the chief executive:
        2. the fees and charges payable, having regard to the costs and expenses incurred by the department of State for the time being responsible for the administration of the Cadastral Survey Act 2002 in providing a national survey control system for—
          1. cadastral surveys supporting title to land under this Act; and
            1. the maintenance of cadastral survey data:
            2. the amount of the fees or charges or the method by which they are to be calculated:
              1. the persons liable to pay the fees and charges:
                1. the circumstances in which and the person by whom the payment of the whole or part of the fees and charges may be remitted or waived:
                  1. the manner in which the fees and charges are to be paid.
                    1. The chief executive or the Registrar may refuse to perform or exercise a function, duty, or power for which a fee is payable until—

                    2. the fee has been paid; or
                      1. the Registrar has accepted a credit arrangement for the payment of the fee.
                        1. Despite subsection (2), the Registrar may—

                        2. dispense with payment of all or any part of a fee payable under this Act; or
                          1. refund all or any part of a fee paid under this Act.
                            1. Regulations made under section 227 may prescribe—

                            2. that interest is payable on an unpaid fee in accordance with Schedule 2 of the Interest on Money Claims Act 2016; and
                              1. the circumstances and manner in which that interest is payable.
