58Compensation for loss or damage resulting from Registrar's error or from system failure

  1. This section applies to a person who suffers any loss or damage as a result of—

  2. an error or a wrongful act or omission of the Registrar or of a person to whom a power or function is delegated under section 233; or
    1. a failure or malfunction of a system or facility used to keep the register under section 9.
      1. The person may bring a proceeding in the court against the Crown for compensation.
