233: Delegation of Registrar's functions, duties, and powers

The Registrar can give some of their jobs to other people. You can be given a specific job or a group of jobs. The Registrar can take back a job they gave to you at any time. The Registrar can give jobs to people who work with them or to people who do not work with them. If you are given a job, you must do it the way the Registrar tells you to. You must follow the rules set by the Registrar under section 236. If someone says they are doing a job for the Registrar, you can assume they are telling the truth. If you do not work with the Registrar and they give you a job, you may need to show proof of this. The Registrar is still responsible for the jobs they give to others.

233Delegation of Registrar's functions, duties, and powers

  1. The Registrar may delegate in writing any of the Registrar's functions, duties, and powers under this Act or any other Act other than—

  2. a function, duty, or power under any of sections 63, 209(2)(b), 214, 216, 225, and 236; or
    1. the power to delegate under this section.
      1. A delegation may be made to—

      2. a specified person:
        1. persons of a specified class:
          1. the holder of a specified office.
            1. A delegation may be—

            2. general; or
              1. specific; or
                1. limited to performing a function or duty or exercising a power in relation to a particular activity or operation or class of activity or operation.
                  1. A delegation may be made to a person whether or not that person is an employee of the department or of any other department or ministry of the public service.

                  2. A delegation—

                  3. does not affect or prevent the performance of a function or duty or the exercise of a power by the Registrar:
                    1. does not affect the responsibility of the Registrar for the actions of a person to whom a function, duty, or power is delegated:
                      1. may be revoked by the Registrar in writing:
                        1. continues in force despite a change in the person holding office as Registrar:
                          1. is subject to any directions or conditions imposed by the Registrar.
                            1. A person to whom a function, duty, or power has been delegated may perform the function or duty or exercise the power in the same manner and with the same effect as if the function, duty, or power had been conferred directly on the person by this Act.

                            2. A person to whom a function, duty, or power is delegated must perform the function or duty or exercise the power in accordance with any standard set or directive issued by the Registrar under section 236.

                            3. A person who purports to act under a delegation is, in the absence of proof to the contrary, presumed to be acting in accordance with the delegation.

                            4. A person to whom a function, duty, or power is delegated who is not an employee of the department must, if requested to do so, produce evidence of the delegation.
