24Duty to avoid unreasonable noise

  1. A person who does any of the following activities must adopt the best practicable option to ensure that any emission of noise from the activity does not exceed a reasonable level:

  2. occupy land (including any premises and any coastal marine area):
    1. an activity in, on, or under a water body or the coastal marine area.
      1. This section does not prevent—

      2. a national rule or rule in a plan from setting controls on the emission of noise; or
        1. a planning consent from including a condition relating to the emission of noise.
