If you want a court to transfer a motor vehicle to you under section 140 or section 141, you must pay some costs first. You have to pay these costs into court before the transfer can happen. The costs include any impoundment costs if the vehicle was impounded under the Land Transport Act 1998, and any costs for seizing, towing, and storing the vehicle.

You must pay these costs within 10 working days after you are told about the decision to transfer the vehicle. If you are given more time to pay by the Registrar, you must pay within that time.

If you do not pay the costs on time, the Registrar can sell the vehicle under section 137 or dispose of it under section 138.

141ACertain payments required before transfers take effect

  1. An order for the transfer of a motor vehicle under section 140 or 141 does not take effect unless the following costs have been paid into court:

  2. if the motor vehicle has been impounded under the Land Transport Act 1998, any impoundment costs:
    1. any costs incurred in seizing, towing, and storing the motor vehicle.
      1. Any costs required to be paid by subsection (1) must be paid within 10 working days after the day on which the lessor or the secured party is notified of the decision to transfer the vehicle, or within any longer period specified by the Registrar in writing.

      2. If the costs specified in subsection (1) are not paid within the time required by or under subsection (2), the Registrar may proceed with the sale of the vehicle under section 137 or its disposal under section 138.
